Regulatory framework
The U.S. EPA enforces against aftermarket parts and tune sellers under Section 203(a)(3)(B) of the Clean Air Act, 42 U.S.C. § 7522(a)(3)(B), which prohibits the manufacture, sale, or installation of any device or component that bypasses, defeats, or renders inoperative any emission control device or system installed on a motor vehicle. Civil penalties are assessed per noncompliant part or installation. The statutory maximum was $4,876 per violation when the bulk of these settlements resolved.
