When a member shop receives correspondence from the U.S. Environmental Protection Agency, the California Air Resources Board, or a parallel state authority, the shop's first call should be to qualified counsel. Member Defense is the operational arm that supports that engagement — document organization, evidence file preparation, drafted response materials — coordinated with the shop's attorney.

Member Defense is a support service for the operational documentation and evidence assembly that any regulatory matter requires. It is not legal representation. Legal Tuning is not a law firm and does not appear on behalf of member shops before the EPA, CARB, the U.S. Department of Justice, or any other authority.
Every Member Defense engagement is conducted in coordination with the member shop's retained counsel. If a member shop has not yet retained counsel, our team will assist in identifying qualified Clean Air Act attorneys.
What Member Defense covers.
The service is structured around the three operational tasks that a regulatory matter typically requires of the affected shop, in sequence.
Evidence File Preparation
Our team works with the shop and counsel to organize the records that will be requested or produced — sales records, product classification files, supplier documentation, off-road use declarations, training acknowledgments, and prior compliance materials. Output: a complete, indexed evidence file in counsel-ready form.
Litigation Hold & Records Preservation
Our team issues the litigation hold instrument to the shop and ensures preservation procedures are in place across email, chat, point-of-sale systems, supplier portals, website backups, and physical records. The hold is documented, dated, and recorded in the shop's member file.
Response Material Drafting
In coordination with counsel, our team drafts the operational portions of the shop's response — description of compliance program, classification methodology, supplier qualification record, and remediation timeline. Counsel reviews, revises, and signs the final response.
What Member Defense does not cover.
- Legal advice or interpretation of statutes, regulations, or enforcement priorities. Provided by retained counsel.
- Negotiation with the EPA, CARB, the Department of Justice, or any other authority. Conducted by retained counsel.
- Filing of pleadings, motions, or formal correspondence on behalf of the member shop. Filed by retained counsel.
- Representations to investigators, agents, or attorneys for the government. Made by retained counsel.
If a member shop is in active regulatory contact and has not yet retained counsel, that is the first call to make — not this service. Legal Tuning can refer member shops to qualified Clean Air Act counsel as needed.
Always-on coverage.
Member Defense is a monthly subscription. If a member shop is contacted by the EPA or a state authority while the subscription is active, the operational scope above is included — no additional fee, no hourly billing.
